Terms of Service

These terms govern your use of Kromi. By creating an account or using the service, you agree to these terms. Please read them carefully.

1. Service Description

Kromi is an AI-powered brand system generator. It allows you to create, edit, and publish brand guideline websites through a visual editor and through AI assistants via the Model Context Protocol (MCP). The service includes project hosting, asset storage, and a shareable published URL for each brand project.

2. Account Responsibilities

You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating your account and keep it up to date. You are responsible for all activity that occurs under your account.

You must be at least 16 years of age to use Kromi. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization to these terms.

Notify us immediately at legal@kromi.app if you believe your account has been compromised.

3. Acceptable Use

You agree not to use Kromi to:

  • Violate any applicable law or regulation
  • Infringe on the intellectual property rights of others
  • Upload or distribute malicious content, malware, or harmful code
  • Attempt to gain unauthorized access to other users' accounts or data
  • Use the service for spam, phishing, or deceptive practices
  • Reverse-engineer, decompile, or attempt to extract the source code of the platform
  • Interfere with or disrupt the integrity or performance of the service
  • Create brand projects that promote hate speech, violence, or illegal activity

We reserve the right to suspend or terminate accounts that violate these guidelines, with or without notice depending on severity.

4. Intellectual Property

Your content is yours. You retain all rights to the brand data, designs, logos, copy, and other content you create or upload to Kromi. We claim no ownership over your brand projects.

The platform is ours. Kromi, including its codebase, design system, templates, documentation, and branding, is the intellectual property of Kromi. You may not copy, modify, or redistribute any part of the platform itself.

By using the service, you grant us a limited license to host, display, and transmit your content solely for the purpose of providing the service to you (e.g., rendering your published brand site).

5. Plans and Pricing

Free tier. Kromi offers a free plan with limited features. Free accounts may create a limited number of projects and are subject to usage restrictions. The free tier may be modified or discontinued at our discretion.

Paid tiers. Paid plans unlock additional features, higher limits, and priority support. Pricing for paid plans is listed on our website and is subject to change. We will notify existing subscribers at least 30 days before any price increase takes effect on their account.

6. Payment Terms

Paid subscriptions are billed on a recurring basis (monthly or annually, depending on the plan you choose). Payment is processed at the start of each billing cycle. All fees are non-refundable except as described in Section 7.

If payment fails, we will attempt to charge your payment method again. If payment continues to fail, your account may be downgraded to the free tier after a grace period.

7. Cancellation and Refunds

You may cancel your paid subscription at any time from your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing cycle. After that, your account will revert to the free plan.

We generally do not offer refunds for partial billing periods. However, if you experience a significant service issue, contact us at legal@kromi.app and we will work with you to find a fair resolution.

Your brand data is not deleted upon cancellation. If your usage exceeds free-tier limits, you will need to either upgrade again or remove projects to fit within the free plan.

8. Service Availability

We strive to keep Kromi available and reliable, but we do not guarantee any specific uptime or service level agreement (SLA), particularly on the free tier.

We may perform maintenance, deploy updates, or experience outages that temporarily affect service availability. We will make reasonable efforts to communicate planned downtime in advance. Paid plans may include enhanced availability commitments as described in their plan details.

9. Limitation of Liability

To the maximum extent permitted by law, Kromi and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the service.

Our total aggregate liability for any claims arising from or related to the service shall not exceed the amount you have paid us in the twelve months preceding the claim.

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Changes to These Terms

We may update these terms from time to time. When we make material changes, we will notify you via email or through a prominent notice in the application at least 30 days before the changes take effect.

Your continued use of Kromi after updated terms take effect constitutes acceptance of those terms. If you do not agree with the changes, you may close your account before the new terms take effect.

11. Governing Law

These terms are governed by and construed in accordance with applicable law. Any disputes arising under these terms will be resolved through good-faith negotiation first. If a resolution cannot be reached, disputes will be settled through binding arbitration.
